| Judge Kimball rules. Ho, hum. |
Jul. 17, 2008
Groklaw has published Judge Kimball's ruling in the historic "SCO vs. Novell" case. After suing Novell for alleged breach of fiduciary duty, the upshot is that the tables have turned, and SCO will have to pay Novell $2,547,817 plus interest.
Both parties may be able to appeal the decision, suggesting that the long, overdrawn case could continue to hobble along even longer than it already has. To quote Steven Vaughan-Nichols, "Like the 11th chapter of a bad horror movie, the SCO zombie keeps stumbling forward moaning "Linux," instead of "Brains."
The matter could even wind up before a jury, according to a Groklaw post. You have to feel really sorry for anyone on jury duty that week.
The details of SCO's various legal chanceries against Linux and companies that use and sell it are difficult to follow. Short version: early in the decade, SCO was considered a major threat to Linux. However, things have been pretty quiet since last August, when Judge Kimball ruled against SCO.
According to Groklaw, Judge Kimball's new ruling upholds his prior Aug. 2007 ruling. Those with an appetite (stomach?) for the legal details can find plenty to feast on in the ruling itself, and in blogs such as Groklaw.net, which rode the massive tide of SCO legal news to prominence during in the early part of this decade.
Meanwhile, readers insatiable for backstory are encouraged to plunder to their gullets' content on the Related Stories below. Enjoy . . . !
