Lindows.com denied ruling; goes to jury

Lindows.com, Inc. announced today that the United States District Court in Seattle has denied their Motion for Summary Judgment on Genericness, challenging the validity of Microsoft's trademark leaving the issue to be decided by jury trial scheduled to start on April 7, 2003.

According to Lindows.com's press release, "the Court concluded that Lindows.com has presented a significant amount of evidence that the relevant consuming public ... in the early 1980s considered 'windows' and its derivatives to constitute generic terms for graphical operating environments, the category of products that included Windows 1.0."

A jury will make the final decision.
